Terms of Service

Article 1 – Application

These General Conditions of Service apply without restriction or reservation to the website www.horjob.com.

Horjob is hereinafter referred to as the “Website”, which is a platform for publishing tasks and jobs in the form of projects to be carried out, and the owners of these assignments are referred to as “project leaders” or ” clients “. Missions carried out by qualified people called “freelancers”.

These general conditions of service define the form of the order, the process of payment and delivery. The customer declares to have read and accepted all these conditions before executing the order procedure via website, as well as the other general conditions of website, and the customer also acknowledges having the capacity required to contract and carry out its transactions through the intermediary of website.

These general conditions of service may be subject to subsequent modifications, the version applicable at the customer’s request will remain the version published on website on the date of the request.

Unless proven otherwise, the data recorded in the site’s system constitutes proof of all transactions concluded with the customer. The validation of the order by the customer also implies acceptance without restriction or reservation of these general conditions.

Article 2 – Customer request

It is up to the client to determine the tasks he needs to carry out his project, and which he wishes to publish on website as follows:

– Once the customer registers on horjob.com, he fills in the data necessary for the publication of his project. He may also be asked when publishing his project to provide additional information, such as files attached to his project.

– After the website validates the project, the client receives proposals or quotes from freelancers, to choose the right freelancer to hire for the agreed amount.

– When the client hires a freelancer for his project, he must pay the freelancer who submitted the work done.

– Thus, it is up to the customer to verify the accuracy of the order and to report any errors as soon as possible.

Article 3 – Rates

When determining the amount of the project, it is in U.S. dollar, all costs included, and the final amount of the project is determined by choosing the amount negotiated between the client and the freelancer.

The price of the project is determined either at the flat rate or at the hourly rate, and the total amount is paid for the project, without calculating the payment costs which will be borne by the customer according to the payment methods available on website.

An invoice is generated by the site and can be viewed after payment and by entering the customer’s details.

Article 4 – Terms of payment

The price will be paid in cash, in full according to the means of payment chosen by the freelancer and the client: bank transfer, by rapid transfer of funds, etc.

The customer chooses the method of payment and accepts the general conditions of service, then the payment is made.

Article 5 – Delivery

The projects ordered by the client will be delivered according to the following process:

– The client receives notification from the freelancer chosen by the contracting authority to implement his project that his project is ready for final delivery.

– The freelancer transmits the work he has done to the client, either via chat messages on the site or by sending a link to download the file stored in Google Drive (cloud storage).

– The client’s acceptance of the files sent and their receipt, then the change of the status of the project to finished, means that the delivery is complete and that the freelancer has the balance available for withdrawal.

– After a period of 7 days from the delivery of the project to the customer, and without changing the status of the project Completed by the customer, the project is automatically accepted for delivery.

– Once the order has been completed and the project has been delivered, the client can request modifications in agreement with the freelancer, and the client has a maximum period of 7 days after delivery.

– The delivery is made from the file transfer of the project carried out for the benefit of the client and the transfer of the related intellectual property rights.

Article 6 – Right of withdrawal

Due to the nature of the services offered, orders placed by the customer do not benefit from the right of withdrawal. Therefore, the contract is definitively concluded as soon as the client chooses a freelancer to carry out his project, and in the event that the freelancer does not respond to the client, the latter may cancel his project in accordance with the general conditions of the site and these terms of service.

Article 7 – Liability of the Site – Warranty

The site will retain the amount of the project and constitute a guarantee, the freelancer will not payed until the client changes the status of the project to “completed” and the work of the freelancer has been evaluated.

The customer must verify receipt of his project within a maximum period of 7 days from the delivery of the order. The website cannot be held responsible for any freelance service.
The website cannot be held responsible for any delay or non-performance whatever the causes.
Also, the website cannot be held responsible in the event of non-compliance with the laws of the country in which the project is submitted, it belongs to the client, and he is solely responsible for the choice of the tasks necessary for his project and also for the selection of a freelancer.
The website cannot provide any protection and guarantee for damages resulting from the implementation of the client’s projects, since the relationship between the client and the freelancer remains private.
The website does not have specific means to verify the counterfeiting of the mission carried out by the freelancer that he has violated the intellectual property rights or other rights. Consequently, the site releases its responsibility in the event that the freelancer or the client does not respect these rights, thus each of the users, whether freelancer or client, remains responsible for his violation of the intellectual property rights or rights of author. The website assumes no responsibility in the event of copyright infringement by site users.

Article 8 – Transfer of ownership – Transfer of risk

Ownership of completed projects will be transferred upon acceptance of the freelance offer under the terms of the agreement between the client and the freelancer, regardless of the date of payment and delivery.

Article 9 – Disposition of missions carried out

Once the freelancer has completed a mission or tasks for the benefit of the client via the website’s platform, and after the freelancer has received his remuneration, the client becomes the owner of the project carried out on his behalf, thus the client freelancers can agree on how to carry out and operate a project in all sections of the open projects on website, where in the absence of an agreement between the freelancer and the client, intellectual property or copyright completed projects will be transferred for the benefit of the client.

Article 10 – Arbitration of the site in the dispute

Each user freelancer or client of website accepts the arbitration of website in the event dispute between freelancer and client.

Any other arbitration costs will be deducted if a dispute is opened during the cancellation of the project. Here, the client’s objection to the freelancer on the tasks performed according to the pre-arranged agreement between them, then for the quality of work or otherwise, users can post comments, ratings through website.
